I/ we do hereby solemnly declare and undertake:
That the project shall be completed by the extended project finish date, i.e.,12/31/2024 and that the desired extension (if granted) of registration of the project shall not affect/ damage the rights and interests of the allottee(s) under the agreement for sale nor will it exonerate the promoter from his obligations to the allottee(s) under the Real Estate (Regulations and Development) Act, 2016 and rules & regulations made thereunder. If, however due to this extension, any damages or losses are suffered by any allottee(s), any rights and interests of any of the allottee(s) are affected or any dispute arises, promoter of the project shall be solely responsible and liable to compensate the same and to resolve the dispute and shall also be liable for all legal and financial consequence of delay in handing over the possession vis-à-vis what is previously agreed with the allottee(s).

8 Rishabh Sharma (10665) It is hereby stated that the total area of the project is 2,40,732.88 sqm. A completion certificate from the Chartered Engineer for an area of 1,28,183.00 sqm has been accepted by the Authority under post-registration application no. RERA-PRD-2022-922. This means that the remaining area to be developed for the project is 1,12,549.88 square meters. However, the promoter has applied for an extension of registration for an additional 41959.74 sqm of the area. When the objection was raised at point no. 3 of para 5/N, the promoter clarified that the Competent Authority had issued partial mortgage release letters on 12.10.2022 & 18.12.2023. Based on this, an application for the acceptance of a partially completed area of 70,590.14 sqm was submitted on 27.12.2023 under the post-registration application module, and thus the remaining area to be developed is 41,959.74 sqm, on which this extension application has been filed. Please note that as of now, the Authority has not accepted the partial CC application for an area of 70,590.14 sqm. The application for the same was filed on 27.12.2023, while the extension application was submitted on 11.12.2023. Therefore, if permitted, the promoter should apply for an extension of registration for 1,12,549.88 sqm instead of 41,959.74 sqm. 14 Rishabh Sharma (10665) It is hereby stated that the entire area of the project is 240,732.88 sqm. The Authority has accepted a completion certificate for 128,183.00 square meters from the Chartered Engineer under post-registration application no. RERA-PRD-2022-922. This means that the remaining area to be developed for the project is 112,549.88 sqm. Regarding the order issued by the Authority on 17.03.2021, the promoter has applied for an extension of 41959.74 sqm, and an application for the acceptance of a partially completed area of 70,590.14 sqm was submitted on 27.12.2023, under the post-registration application module with application number RERA-PRD-2023-1437. However, it is unclear which work has been completed in the project and which has not since the mortgage release letter has not been issued for all the plots. Application for the partially completed area was filed on 27.12.2023, while the extension application was submitted on 11.12.2023 - which is after the submission of the extension application. This means that the benefit of the area under the partial CC application may not be provided in this extension application. Hence, the application for extension of registration of the project needs to cover 1,12,549.88 sqm area instead of 41,959.74 sqm. 26 Promoter Applicant humbly submits that: Partial completion certificate issued by the competent authority i.e. Chartered Engineer Nagendra Chaudhary on 20.09.2022 on area 128183 sq mtr. Further, Jaipur Development Authority has issued the mortgage free letter dated 12.10.2022 vide letter no. जवीप्रा / उपा. / ज़ोन - 12/2022/ डी-3472 which substantiate the completion of the project upto 55.18 %. The applicant completed the said project to the extent of 82.57% by 23.11.2023 and the same can be verified from the report of the chartered engineer dated 25.11.2023. The Jaipur Development Authority has issued the mortgage free letter for 4261.46 sq mtr more plot area, dated 18.12.2023 vide letter no. जवीप्रा / उपा. / ज़ोन - 12/2023/ डी-9995. The completion certificate of chartered engineer dated 25.11.2023 which substantiate the completion of the project upto 82.57%. Thus, marking the completion of 198773.14 sq mtr. 1. Mortgage Release Letter from JDA dated 12.10.2022 against said 55.18 % works completed earlier i.e. 128183 sq mtr has been completed. 2. Mortgage Release Letter from JDA dated 18.12.2023 against said 27.43 % works completed in addition to 55.18 % work completed i.e. 1,98,773.13 sq mtr has been completed. We have also uploaded a hatched site plan showing the work completion of the project; two of block i.e. Block 1 and Block 3 (55.18 % are fully completed including their common facilities (Hatched in red and blue). Adding to it, Block 2 and Block 4 are partial completed including their common facilities also. (Hatched in green and yellow) against which local body has issued the mortgage free letter for 27.43 % more plot area, making it a total of 82.57%. Therefore, 1,98,773.13 sq mtr will be deducted from total project land area (2,40,732.88 Sq. mtr.) 27 Rishabh Sharma (10665) Under the provision of Township Policy 2010, the project completion period is 36 months for the scheme more than 2 Hec., thus, the completion time of your project was up to 14.12.2021, and you have applied for an extension of registration up to 31.12.2024, which is double the time frame under Township Policy. 32 Promoter Dear Sir, This is the most humble submission to the Hon’ble authority that CC issued on 20-09-2022 has been accepted by the Hon’ble authority on 09-03-2023. There are various other projects where authority has accepted the CC issued by Registered Chartered Engineer in case of plotted development (as per township policy 2010 refer page no. 14 of attached policy) namely; Sukhija Vihar-B, Auditors Enclave, Auditors Enclave Ext., Chandra Lok City, Madhuvan Vatika, Shanti Enclave, Tej Singh Nagar, Pushp Vihar etc. Further, the local authority i.e. Jaipur Development Authority has issued two mortgage free letters namely, first, Mortgage Release Letter from JDA dated 12.10.2022, Second, Mortgage Release Letter from JDA dated 18.12.2023 are submitted to RERA Authority on web portal vides post registration module (RERA-PRD-2023-1437) accepted by authority on 03-06-2024. Therefore, mortgage free letter(s) issued by local authority is admitted by RERA authority. Thus, relive us from depositing the fee on the complete area. 34 Promoter Dear Sir, This is the most humble submission to the Hon’ble authority that the applicant was called for hearing on 26.04.2024, where the matter was discussed in front of Hon’ble Chairperson and it was decided that after the approval of service drawing application and partial completion certificate application, authority would proceed towards the further approval of extension application. It is pertinent to mention here that the authority, on 20.05.2024, approved the application for service drawings and on 03.06.2024, approved the application for partial completion certificate. Further, it is submitted that, the total area of the project is 2,40,732.88 sq.m, and the completion certificate of the Chartered Engineer for an area of 128,183.00 sq.m has been accepted by the Authority under application no. RERA-PRD-2022-922. In application no. RERA-PRD-2023-1437, the promoter submitted mortgage release letters dated 12.10.2022 & 18.12.2023, according to which 12,974.64 sq.m of mortgage area out of the total mortgage area of 15,895.46 sq.m has been released which was also accepted by the authority. Therefore, completion of 70,590.14 sq.m through application no. RERA-PRD-2023-1437 and completion of 128,183.00 sq.m through application no. RERA-PRD-2022-922, concluding the completion of 1,98,773.14 sq mtr out of 2,40,732.88 sq mtr, both was duly accepted by the authority. Hence, applied for extension of remaining area i.e. 41959.74 sq mtr. Further, as per the direction/observation of the authority, dated 26.04.2024 in hearing, with regards of the approval of service drawings and completion certificate, our both the applications are duly accepted by the authority. Therefore, it is requested to kindly relieve us from depositing the fee on the complete area and proceed towards the further approval of the extension application. 36 Ramesh Sharma (9009) On perusal of the documents uploaded in the extension application, it is seen that total area of 15,895.46sq mtrs was mortgaged as 12.5% at the time of approval of the layout plan of the project. out of it on 12.10.2022 8,713.18 sq mtrs of area was mortgaged free by JDA on the basis of the report of Chartered Engineer. Again on 18.12.2023 on the basis of the Chartered Engineer 4,261.46 Sq Mtrs of the Mortgaged plot area was released. Thus, a total of 12,974.64 sq mtrs is released till date by JDA. Which are duly approved partial CC by JDA and the same has been approved by the Authority . Now remaining area mortgaged is 2920.82 Sq mtrs. Looking to the above facts the Promoter has rightly applied for the extension of the partial area which is to be completed by him during extended period. Promoter has uploaded relevant documents of partial completion certificate on page 39 and 40 and relevant phase plan on page 41 in the tab of other documents.
